Though the Indian Constitution guarantees Right to Equality as a fundamental right, yet on many occasions gender based discrimination was prevalent. In the era of judicial activism, public interest litigation and women empowerment, many laws and rules were challenged and new interpretations were given to the old laws or they were struck down by the judiciary to fulfill the constitutional mandate of equality and justice for all. These judgements range from maintenance of a wife, acknowledging 'mother' as a natural guardian of her child to enacting a whole new law to protect women at their workplace in order to ensure that each one has a dignified life.
