In Britain and America, bail is generally explained as the defendant's right; while in civil law countries, bail is usually explained as the nation's right or a kind of coercive measure, in which bail is just a process mode of ceasing the detain or cancelling the detain. Due to such a difference in concept, specific institutional arrangements and designs are different in these two types of countries. From macro and micro perspectives, the book argues some defects existed in the system of obtaining a guarantor pending trial; these defects are not superficial but existed in the inner mechanism of the system; so just the remedy in legislation for these defects cannot make the bail system adapt to the development of modern law and the reform of criminal procedure law. In the author's opinion, the relatively feasible method is to abolish the system of obtaining a guarantor pending trial and replace it with bail system.
