It gives an overview of the relevant laws that apply to malpractice claims arising out of negligent health care treatment in England and Wales while considering the adequacy of the tort compensation system with precise reference to achieving tripartite justice - justice to the victim, to the offender and to the larger community. Consideration is thus given to the procedural and substantive laws; all geared towards improving the workings of the tort compensation system where it turns out to be inefficient.
